No, an employer in the UAE cannot legally hold an employee's passport. The UAE Labour Law prohibits employers from confiscating employees' personal documents, including passports. Employees have the right to retain possession of their passports at all times.
While the search results do not explicitly cite the relevant legal provision, this rule is established under the UAE Labour Law and reinforced by guidance from official sources and labour authorities. Employers found in violation may face penalties.
Employees whose passports are being withheld should contact the Ministry of Human Resources and Emiratisation (MOHRE) for assistance.
